1. Agreement to Terms

By accessing and purchasing from the EldurVind website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("Customer," "you," or "your") and EldurVind ("we," "us," or "our"). If you do not agree with any part of these terms, you must not use or make purchases from our Site. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the Site following any changes signifies your acceptance of the revised terms.

2. Products & Purchases

EldurVind sells shorts, tops, t-shirts, and matching sets as described on the Site. All product descriptions, images, and prices are subject to change without notice. We strive for accuracy but do not warrant that product descriptions, colors, or other content are entirely error-free. We reserve the right to limit sales, discontinue products, or correct errors in pricing and product information. Your order constitutes an offer to purchase, which we accept upon sending an order confirmation email. We may cancel any order at our sole discretion.

3. Limitation of Liability

To the fullest extent permitted by applicable law, EldurVind, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total cumulative liability to you for all claims arising from or related to your use of the Site and our products shall not exceed the total amount you paid to EldurVind for the specific product giving rise to the claim in the twelve (12) months prior to the claim.

4. Intellectual Property Protection

All content on the EldurVind Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the overall "look and feel" of the Site, is the exclusive property of EldurVind or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

The "EldurVind" name and logo, and all related product and service names, design marks, and slogans are trademarks of EldurVind. You are not permitted to use any of our trademarks, service marks, or logos without our prior written consent. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Site content for any commercial purpose without our express written permission.

5. Refund & Return Policy

We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible items within 30 days of the original shipment date for a refund to the original payment method.

• Eligibility: Items must be unworn, unwashed, and in their original condition with all tags attached. For hygiene reasons, certain final sale items (e.g., undergarments, swimwear) may not be eligible for return unless defective.
• Process: To initiate a return, please contact our customer service team at [email protected] to obtain a Return Merchandise Authorization (RMA) number and instructions. Returns sent without an RMA may not be processed.
• Refunds: Once we receive and inspect your return, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed to your original payment method within 10 business days. Please note that original shipping costs are non-refundable, and you are responsible for return shipping fees unless the return is due to our error (e.g., wrong or defective item shipped).
• Exchanges: We currently do not offer direct exchanges. To exchange an item, please return the original item for a refund and place a new order for the desired item.
• Damaged or Defective Items: Please contact us immediately at [email protected] if you receive a damaged or defective product. We will arrange for a replacement or refund and provide a prepaid return label if necessary.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
